DC Attorney General’s Litigation Against the NRA Stayed

On February 1, 2021, DC Superior Court Judge Jose M. Lopez issued a short decision and order staying the DC Attorney General’s enforcement action against the NRA and NRA Foundation because of the NRA’s filing for bankruptcy. The court’s primary reasoning was that the relief sought, the imposition of a constructive trust imposed on funds held by the NRA, would render “the same funds not available for distribution in the bankruptcy.” (p.3) 


The Court had previously rejected the bulk of the NRA and NRA’s Foundation’s arguments on a motion to dismiss and the case will resume after the NRA’s Chapter 11 matter is resolved.
